Golf.com Challenge Sweepstakes
(the "Sweepstakes") SWEEPSTAKES RULES NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. Eligibility To be eligible for this Sweepstakes (an "Eligible Player") you must meet all of the following requirements:
Your participation in this Sweepstakes constitutes your full and unconditional agreement to these Sweepstakes Rules and the Sweepstakes Sponsors' decisions, which are binding and final in all matters related to the Sweepstakes. How to Enter Between 12:01 a.m. EDT on Saturday, October 27th, 2007 and 11:59 p.m. EST on Sunday, November 4th, 2007 (the "Sweepstakes Period"), there will be a set of three (3) different cash-entry Tournaments and nine(9) different free-entry Tournaments, identified as "Golf.com" (each, a "Qualifying Tournament") in the Tournament Lobby of UTour Golf available at www.utourGolf.com. To enter the Sweepstakes, you must complete at least one game (each, a "Qualifying Game") in any of the Qualifying Tournaments during the Sweepstakes Period. You will receive one (1) entry (a "Ballot") into a random draw (the "Random Draw", as described below) for each Qualifying Game you complete during the Sweepstakes Period. The Prize Following the end of the Sweepstakes Period, a representative of the Sweepstakes Sponsor will conduct a random draw from all Ballots received and select one Ballot for the Prize. The Eligible Player associated with the selected Ballot will, subject to these Sweepstakes Rules, receive a trip for two (2) to the 2008 Michael Jordan Celebrity Invitational Tournament (January 16-20, 2008), including round trip economy airfare from the continental U.S. airport hub closest to the home of the selected Eligible Player, double-occupancy hotel accommodations for 4 nights, ground transportation to and from Nassau International Airport in the Bahamas, one (1) round of golf during the trip (but not as part of the 2008 Michael Jordan Celebrity Invitational), and access to other activities and/or events as the Sweepstakes Sponsors may determine in their sole discretion (collectively, the "Prize"). The selected Eligible Player and his/her guest, if any, are solely responsible for (i) any income taxes based on the Prize, (ii) any service charges, taxes, health insurance and cancellation insurance, meals, personal expenses, gratuities and any other incurred fees not outlined in these Sweepstakes Rules, and (iii) any transportation to and from the continental U.S. airport hub referenced above and any costs associated with travel to and from such airport hub. The selected Eligible Player and his/her guest, if any, must be legally able to travel to, from, and within the United States and the Bahamas. Any necessary travel documentation such as valid passports and entry visas are the sole responsibility of the selected Eligible Player and his/her guest. The approximate retail value of the Prize is $4,500.00 USD. The odds of winning the Prize depend on the number of Ballots in the Random Draw. Sweepstakes Sponsors are unaware of how many Ballots there may be. The Prize is not transferable. No substitutions or cash redemptions are allowed for the Prize. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS, EXPENSES AND INCIDENTALS ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Requirements for the Winner The Eligible Player who has been selected for the Prize (the "winner") must meet ALL of the following requirements (the "Prize Award Requirements") before being awarded the Prize:
General The Sweepstakes Sponsors' rulings are final and without appeal in all matters related to the Sweepstakes and the awarding of the Prize. By participating in this Sweepstakes, each Eligible Player consents to the use of the his/her name, image, likeness, voice, username, gameplay data, city, state and country of residence, and other biographical materials, for the Sweepstakes Sponsors' advertising, publicity and promotion purposes without territorial, time or use limitations, including without limitation online announcements, without additional compensation, unless prohibited by law. Winners consent to their photograph being taken by Sweepstakes Sponsors for such use, without further compensation. All entries become the property of the Sweepstakes Sponsors who assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the Web site during the Sweepstakes Period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e mail or traffic congestion on the Internet or at any Web site, or any combination thereof including any injury or damage to an Eligible Player's or any other person's computer related to or resulting from playing or downloading any material in the Sweepstakes. Eligible Players are encouraged to visit www.utourGolf.com at least half-an-hour prior to the Sweepstakes Period to ensure that they have the software required to play a Qualifying Game to enter this Sweepstakes. Sweepstakes Sponsors take no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors. The Sweepstakes Sponsors reserve the right to cancel, terminate or suspend this Sweepstakes in whole or in part, or to amend these Sweepstakes Rules, if for any reason the Sweepstakes is not capable of running as planned. Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, the Sweepstakes Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. This Sweepstakes will be run in accordance with these Sweepstakes Rules, subject to amendment by Sweepstakes Sponsors. Eligible Players must comply with these rules, and through their participation in the Sweepstakes will be deemed to declare that he or she has fully complied with and agrees to be bound by these Sweepstakes Rules and agrees, on behalf of himself/herself and his or her heirs, executors and administrators to release the Sweepstakes Sponsor and its affiliates, agencies, and/or representatives from any and all liability, claims and demands arising out of participation in the Sweepstakes or of the awarding or use of the Prizes described herein. These Sweepstakes Rules shall be governed by the laws of the Province of Ontario. The Sweepstakes is subject to all applicable jurisdictional laws and regulations and is void where prohibited by law.
